Terms of Service — SpotTheUI

1. Acceptance of Terms

By accessing or using SpotTheUI ("the Service"), located at www.spottheui.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and SpotTheUI, operated by Ruben Cespedes.

2. Description of Service

SpotTheUI is a web-based design education platform that teaches UI/UX design principles through interactive A/B comparison challenges. The Service offers a free tier (60 challenges) and a paid premium tier (480 challenges) available through a one-time purchase.

3. Accounts

To use certain features, you must create an account using an email address and password or by signing in with Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to update it as needed. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments and Premium Access

Premium access to SpotTheUI is available for a one-time payment of $9.99 USD. This grants you lifetime access to all challenges, difficulty tiers, and the full badge system. Payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service. Prices are subject to change, but any change will not affect purchases already completed. "Lifetime access" means access for as long as SpotTheUI continues to operate.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws. Attempt to gain unauthorized access to the Service, other accounts, or our systems. Interfere with or disrupt the Service or servers connected to it. Reproduce, distribute, or publicly display content from the Service without permission. Use automated tools (bots, scrapers) to access the Service. Reverse-engineer, decompile, or attempt to extract source code from the Service. Share your account credentials with others or allow multiple people to use a single account.

6. Intellectual Property

All content on SpotTheUI — including challenge designs, mockups, explanations, text, graphics, logos, and code — is the property of SpotTheUI and Ruben Cespedes and is protected by copyright and intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any content on the Service without our express written permission. Your use of the Service does not grant you any ownership rights to any content.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. SpotTheUI is an educational tool and does not guarantee any specific learning outcomes, career results, or professional qualifications.

8. Limitation of Liability

To the fullest extent permitted by applicable law, SpotTheUI and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $9.99 USD, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless SpotTheUI, its operator, and any affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 6 through 9 of these Terms survive any termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Miami-Dade County, Florida.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
